ADA Compliance Requirements

On September 15, 2010 the U.S. Department of Justice (DOJ) published the final rule adopting revised ADA Standards for Accessible Design (2010 ADA Standards) in the Federal Register.  The new regulations impact ATM accessibility and communication related elements and will require the majority of ATMs in the country to be upgraded or replaced in order to comply with the new Standards. The communication-related elements (speech output requirements) of the new Standards do not qualify for safe harbor and will not be “grandfathered”. Thus, every ATM must provide voice guided transactions (speech output) by March 15, 2012.

Important Dates:

  • July 26, 2010 – DOJ issues final ruling on ATM accessibility standards
  • September 15, 2010 – Regulations were published in the Federal Register
  • March 15, 2011 – Effective date of ruling, each financial institution must have a compliance plan
  • March 15, 2012 – All ATMs must comply with new 2010 ADA Standards (every ATM must be speech enabled)
